Uh, yeah. That clearly falls into the 'acts of nature' and that law suit will probably not go very far, though they'll probably get a cash settlement from the school's insurance to settle it quick and keep it out of court.

If she had been killed, struck by a teen in a speeding car, while sitting in the school parking lot? Not the school's fault. Had a piece of space junk fallen from the sky and destroyed her and her car? Not the school's fault.

It's likely driven by the family's insurance company, trying to get some money out of another insurance company. A lot of these weird cases are driven by insurers.

Yep.  Sometimes, though, insurance companies can be a real pain though.  I remember ages ago, would have been in the '90s, I was at a friend's house one evening.  Went to leave and my car door wouldn't open.  I could open it 2-3".  Looking closer, the front quarterpanel was damaged.  The only way it could have been hit was the people next door: no fence.  Called the police because I'm not going to file an insurance claim without a police report.  I get the report, get my car fixed.  Guy's daughter, IIRC, went to move his truck because boyfriend was coming over.  Clipped my car.  Dad was disabled from a workplace injury.  Turned out later that my insurance company paid for the repair under MY policy under underinsured/uninsured side.  The other insurance company claimed that there was no way to know who in the family hit my car!  grumble grumble

Exactly.  If she got home, stepped out of her car, onto her kid's skateboard that he'd left next to the driveway, fallen and broken her neck and died, would the family have sued the kid?

I'm pretty sure skateboard makers are indemnified against accidents, unless they can prove a manufacturing defect in the board.  It's kind of part and parcel since boarders modify their boards so much.
